Operators spend most of their evaluation time comparing loyalty features. They spend almost no time reading the data ownership clause, and that clause is what determines how painful it is to ever leave.

Why This Matters More Than It Seems

Guest data, purchase history, play patterns, segmentation, is the most valuable asset an operator builds on top of any CRM platform. Some vendor contracts are written so that this data is difficult or costly to export in a usable format if the operator ever switches platforms. That is not always visible during a sales cycle, and it becomes very visible the moment an operator wants to leave.

What "Data Ownership" Should Actually Mean

A clear data ownership clause should state plainly that the operator owns their guest data outright, that the vendor's role is custodial, and that the operator can request a full, structured export at any time, not just at contract termination. We look for contracts that specify export format and timeline explicitly, since "you can have your data" is a very different commitment from "you can have your data within thirty days in a standard, usable format."

Portability in Practice

Owning your data on paper is not the same as being able to use it elsewhere. A guest record exported as a proprietary, undocumented file format is functionally much harder to migrate than one exported as a clean, standard schema. We recommend asking a vendor for a sample export file during evaluation, before signing, so your team can confirm it is genuinely usable rather than taking the portability claim on faith.

What to Ask Before You Sign

Specific questions worth putting directly to a vendor: what happens to guest data if the contract ends, is there a fee for a full export, what format does the export come in, and how long does an export request take to fulfill. We'd also recommend asking whether the vendor has ever declined or delayed a data export request from a departing customer, since past behavior here is a more reliable signal than the language in a standard contract template.
